TERMS AND CONDITIONS

NOTE TO CUSTOMER: You should read these Hire Contract terms carefully. They contain terms and conditions which may impact on you, as customers may be liable for damage to goods that are hired from Illuminated Rentals Event Hire.

ALL HIRES ARE SUBJECT TO THESE TERMS, AND THE CUSTOMER BY BOOKING A HIRE CONFIRMS ACCEPTANCE OF THESE TERMS AND AGREES TO BE BOUND BY THEM.

1.INTERPRETATION OF WORDS IN THIS CONTRACT:
CUSTOMER – refers to the person or organisation hiring the Hired Items from Illuminated Rentals Event Hire
HIRE CHARGE – The amounts shown on the Hire Schedule payable by the Customer to hire the goods
HIRE PERIOD – Means from commencement until the end of the period shown on the Hire Schedule. The Hire Period may only be extended if the Customer requests it and if Illuminated Rentals Event Hire agrees.
HIRE SCHEDULE – Document setting out the terms of hire of the Hired Items
ILLUMINATED RENTALS EVENT HIRE – The Hirer listed on the Hire Schedule

2. ILLUMINATED RENTALS OBLIGATIONS
Illuminated Rentals Event Hire will:
     2.1 Allow the customer to take and use the Hired Items for the Hire Period
     2.2 Provide the Hired Items to the Customer clean and in good working order

3. OBLIGATIONS OF THE CUSTOMER
The Customer must:

3.1 Hand back the Hired Items to Illuminated Rentals Event Hire in the same condition as when it was delivered. Failure to do so will result in the Equipment Security Bond (see Clause 5) being retained to cover costs associated with cleaning and repair of the Hired Items

3.2 Operate the Hired Items safely, strictly in accordance with the law, and in accordance with any instruction supplied by Illuminated Rentals Event Hire.

3.3 Indemnify Illuminated Rentals Event Hire for all injury and/or damage to the extent caused or contributed to by the Customer to persons or property in relation to the Hired Items and their use

3.4 Ensure that all persons operating or erecting the Hired Items are instructed in their safe and proper use

3.5 Conduct a thorough hazard and risk assessment before using the Hired Items and comply with all Occupational Health and Safety laws relating to the Hired Items and their operation

3.6 Report and provide full details to Illuminated Rentals Event Hire of any accident or damage to the Hired Items

3.7 Sign any documentation requested by Illuminated Rentals Event Hire, to confirm the Customer’s acceptance of these Hire Contract conditions

The Customer must not:

3.11     Tamper with, damage or repair the Hired Items

3.12     Lose or part with possession of the Hired Items

3.13     Place the Hired Items near firepits, hot food or drinks, or leave the Hired Items sitting in water

3.14     Rely upon any representation relating to the Hired Items or their operation other than those provided by Illuminated Rentals Event Hire

4. PAYMENTS BY THE CUSTOMER TO ILLUMINATED RENTALS EVENT HIRE

4.1       The Customer will pay a 20% non-refundable deposit to secure the booking, with the balance due one week prior to delivery, unless requested otherwise by Illuminated Rentals Event Hire

4.2       Immediately on request of Illuminated Rentals Event Hire, the Customer will pay

(a)        the new list price of any Hired Item which is not returned to Illuminated Rentals Event Hire

(b)       all costs incurred in cleaning the Hired Items

(c)        the full cost of repairing any damage to the Hired Items caused by the Customer

(d)       all costs incurred by Illuminated Rentals Event Hire in recovering possession of the Hired Items

(e)        any reasonable expenses and legal costs incurred by Illuminated Rentals Event Hire in enforcing this contract due to the Customer’s default

5. EQUIPMENT SECURITY BOND

5.1      The Customer will pay an Equipment Security Bond (the Bond) of such amount as shall be determined by Illuminated Rentals Event Hire, payable at the same time as the balance as defined in clause 4.1 above

5.2      If no amount is payable by the Customer under Clause 4.2 the full amount of the Bond will be refunded to the Customer.

5.3      In the event that there is an amount payable by the Customer under Clause 4.2 above the Bond will be applied towards that sum payable by the Customer

(a)      If the Bond is insufficient to cover the amount due the Customer will pay the excess over the Bond

(b)    If the amount due by the Customer is less than the Bond the difference between the amount payable and the Bond amount will be refunded to the Customer

6. POSTPONEMENT AND CANCELLATION POLICY

6.1    Should the Customer postpone their booking more than 7 days prior to the commencement of the Hire Period, no extra charges apply, and the booking will be rescheduled

6.2   Should the Customer postpone their booking less than 7 days prior to the commencement of the Hire Period, a $100 administrative fee will be applied

6.3    Should the Customer cancel their booking more than 7 days prior to the commencement of the Hire Period, the 20% non-refundable deposit will be forfeited

6.4    Should the Customer cancel their booking less than 7 days prior to the commencement of the Hire Period, the 20% non-refundable deposit PLUS 50% of other amounts paid will be forfeited
